According to the current Housing Code, the elevator in apartment building is a common property and belongs to the owners of premises on the basis of the right of common shared ownership.

And only the organization that serves the apartment building, that is, the management company or the HOA, can turn on the elevator.
But the whole problem is that in order to create or select it, a decision of a general meeting of more than 50 percent of the owners of premises is necessary, that is, half of the house should be inhabited by the owners of the apartments. And since, for a new building, this condition is impracticable, the elevator is turned on after a year, and sometimes two, when a sufficient number of tenants are recruited.

But, it often happens that the elevator does not turn on even with the current Criminal Code.
This happens for several reasons.

First, because of the cost savings. Elevator maintenance is not cheap, and until residents move in and start paying their bills, the company prefers to simply "hold back the costs."

Secondly, the Criminal Code understands that during repairs during lifting building materials or furniture, residents may overload elevator in a new building and break it down. Thus, they insure themselves against possible subsequent repair costs.

Therefore, if you pay such bills, and the elevator does not work, then you have the right to demand a recalculation from the Criminal Code from the moment the application is submitted until the shortcomings are corrected. The application must be sent in writing and be sure to check that it is officially accepted (put the incoming number and take it to work).

Some companies deliberately do not include the cost of servicing the elevator equipment in the tariff while the cabs are "idle".

In this case, it is necessary to operate with legislation. Gosstroy Resolution No. 170 of September 27, 2003 clearly defines that “organizations for servicing the housing stock should provide operation of elevator equipment ". And it was also noted that the deadline for troubleshooting is 1 day from the date of receipt of the application.

Therefore, in this case, you need to write a claim and send it to the Criminal Code with the requirement to connect the elevator and not prevent apartment owners from using their common property (Consumer Rights Protection Law). It is desirable that the claim is signed by as many owners as possible.

In accordance with article 31 of the Law on the Protection of Consumer Rights (dated February 7, 1992 N 2300-1), the Criminal Code is obliged to respond to you within 10 days. If the answer of the Criminal Code does not suit you and your requirements are not met, then you can apply with a written statement about the violation of your housing rights and consumer rights to Rospotrebnadzor, the Prosecutor's Office and the State Housing Inspectorate.
