At first glance, it will seem that this is a very complex and time-consuming process.

You have decided to start your own business: you have an idea, a plan and agreements with investors. It would seem that all that remains is to take and do. But the most unpleasant thing begins - the paperwork. We have compiled a checklist that will help you. Follow the steps in order, and you will register the IP yourself.

How much does it cost to open an individual entrepreneur in 2018

  • 800 rubles - registration fee
  • 1,000-1,500 rubles - for a notary, if you send documents by mail or through a representative. When you visit the tax office personally, you do not need to certify the application with the notarus.

Step 1: Choose your taxation system

Decide in advance how you will pay taxes in order to submit an application for choosing a taxation system along with the registration documents.

Now in Russia there are 5 systems of taxation. We recommend paying attention to the STS, UTII and patent. They are designed specifically for small businesses to reduce tax burden and simplify bookkeeping.

Step 2: Determine your type of activity according to OKVED

In the documents for registration as an individual entrepreneur, you must indicate the activity code according to the OKVED directory. Identify a few codes that you are or will be doing.

Step 3: Prepare documents for registration of an individual entrepreneur in the tax

To register an individual entrepreneur, you will need the following documents:

  • Passport with photocopy or its notarized copy.
  • Application for state registration. If you send documents by mail or submit through a representative, certify the application with a notary.
  • Receipt for payment of the state duty of 800 rubles.
  • Copy of TIN certificate. If it is not there, then the TIN will be assigned to you during the registration process.
  • Power of attorney for a representative, if someone will hand over documents for you.
  • Notification for the application of the simplified tax system, if you have chosen this taxation system. Prepare two copies. One will be taken by the tax office, and on the second they will put a mark on the acceptance of the application.

The second way to apply for registration as an entrepreneur is through the MFC (multifunctional center of public services). There are such centers in every region. Call the MFC in advance and check if they accept registration documents. Not everyone does this. The MFC in Moscow accepts documents only if there is a residence permit in the Basmanny District.

If you cannot come in person, send the documents to the tax office by mail with a valuable letter or submit through a representative using a power of attorney. But before that, certify the application and a copy of your passport with a notary.

The tax office will give you a receipt for the documents. Save it, you will need it when you pick up the registration documents for the individual entrepreneur.

Step 5: Obtaining documents on registration as an individual entrepreneur

You will be registered as an individual entrepreneur in 3 working days and the following documents will be sent to your e-mail: a list of the state register of an individual entrepreneur and a certificate of registration with the tax office.

The tax office will inform you about the registration of the individual entrepreneur in the pension fund, which will assign you a registration number. You will need it to pay insurance premiums. Find out the number in the PFR office by registration or in the extract of the EGRIP on the tax website.

If you submitted an application for the transition to the simplified tax system, then the confirmation will be its second copy with a tax stamp of acceptance. Additionally, in the tax office, you can request an information letter on the application of the simplified tax system. Sometimes banks and counterparties ask him.

It is not necessary to receive a notification with the assigned statistics codes, but the codes may be needed for reporting to Rosstat. And also some banks ask for a notification when opening a current account. In some regions there is an online service of Rosstat, which will help to find out required codes... To get an official letter with statistics codes, contact the Rosstat office (the address can be found on the website).

So you've decided to become an entrepreneur! A good prospect for those who are tired of depending on their bosses and want to become the master of their lives! One of the options for solving this issue is the registration of an individual entrepreneur. What you need to open an IP - this is our detailed material.

IP - who is this?

To become an individual entrepreneur, or an individual entrepreneur, is most advisable for those who want to operate as an individual, that is, without forming a legal entity.
What is the difference? Is that legal entities must have an authorized capital and a legal address. An individual entrepreneur is exempt from these conditions, however, there is one important point- according to the law, an individual entrepreneur must be liable for obligations with all his personal property.

How does an individual entrepreneur differ from a private person who works without registration, what is called "for himself"?

Firstly, when registering an individual entrepreneur, work experience... Secondly, illegal employment is punishable. Well, and thirdly, if the activity is related to the wholesale purchases of goods, then many firms do not provide supplies for private traders.

Who can be registered as an individual entrepreneur?

  • All adult capable citizens of the Russian Federation;
  • Minors recognized as capable by the relevant authorities;
  • Minors who have permission to engage in entrepreneurial activity from their parents or guardians;
  • Foreigners, with a temporary or permanent Russian residence permit.

Are there any exceptions? Yes there is! The legislation of the Russian Federation prohibits the opening of an individual entrepreneur to citizens in the state and municipal service. For all other working citizens, there are no obstacles in terms of registration of an individual entrepreneur.

What you need to open an IP - the first steps!

Registering an individual entrepreneur will not really present you a lot of work. But first, you will need to take a number of actions that will allow you to carry out the registration procedure in the future without delay.
The fact is that even before submitting documents to the relevant authorities, it is necessary to decide on some fundamental points.

1.Choose types of activities.
There is an All-Russian classifier of species economic activity(OKVED), in which a certain code is assigned to each type of activity. Therefore, a future entrepreneur needs to choose a field of his activity and, based on this, determine its code according to OKVED.
An important point: you can specify several codes, but the code of your main activity must be specified first. It is not forbidden to choose several codes at once with an eye to the future expansion of activities.
If, in fact, any kind of activity is not carried out, no sanctions from the tax and other structures will follow. And when a favorable moment comes for expanding the business, you will not need to go to the tax office again in order to make changes or additions to the activity codes.

2. Decide how we will pay taxes.
This issue also needs to be resolved in advance so as not to delay the registration process in the future. Most optimal solution for individual entrepreneurs, a simplified taxation system (STS) is considered.
Here you will need to make a choice of the object of taxation. There are two of them: "income" and "income minus expenses". In the first case, the tax rate will be 6% on all your business income. If the second option is chosen, the rate, depending on the region, will vary from 5 to 15%.
In addition to the simplified tax system, it may be convenient for individual entrepreneurs Patent system taxation (abbreviated as PSN), the Unified Imputed Income Tax (UTII) and some other special tax regimes, depending on the type of activity.

3. Get TIN.
It is advisable to obtain a TIN in advance - the taxpayer identification number. If it is already there, well, if not, then we submit an application for its receipt to the tax office at the place of registration.
Obtaining a TIN can be timed to the submission of documents for registration of an individual entrepreneur, but this may somewhat delay the registration period.

4. Pay the state fee.
For registration of an individual entrepreneur, you must pay a state fee. This can be done at any branch of Sberbank. For several years now, the amount of the duty has remained within the range of 800 rubles. However, you should be aware that a bill has already been submitted to the State Duma to increase the fee for registering entrepreneurial activity. So it is not surprising if this amount changes upward soon.

Collecting documents for registration of an individual entrepreneur!

So everybody preparatory activities completed, we begin to collect together all the documents that are needed to open an individual entrepreneur: a passport, a photocopy of a passport, a receipt for payment of a state duty, a TIN and its copy, a completed application for registration of an individual entrepreneur - you can download it on the website of the Federal Tax Service (form P21001), or take form in the nearest tax office.

A few words should be said about filling of this statement... The fact is that, despite the sufficient simplicity of the form, you can easily make mistakes in filling it out. Especially carefully you need to fill in the passport data - strictly in accordance with how they are spelled out in the passport itself!

In addition, blots and typos are strictly not allowed, so be very careful when filling out an application. Everything is not so difficult, especially since there are a lot of sites on the Internet with examples of how to correctly fill out the P21001 form.

The application consists of 5 sheets, which must be numbered, stitched and signed with your signature.
If you personally go to register your individual entrepreneurship, then this stage preparation of documents is finished.
In case documents are sent through an intermediary or by mail, notarization of the documents and your signature is required.

Forward to the tax office!

So we came directly to the registration of an individual entrepreneur, that is, to a visit to the tax office. But not the first one that came across, but the one that is located at the place of your official registration. The actual place of residence does not play a role in this.

Example: you are registered in Khabarovsk, and live in Moscow, where you are going to conduct your business. The documents for registration of an individual entrepreneur must be submitted in Khabarovsk! It is in this case that there is a need to resort to help Email(through special services), intermediaries by proxy or to the services of the Russian post.
If there is no permanent registration in the passport, it is allowed to issue an individual entrepreneur at the address of temporary registration.
In case of a personal appeal to the department of the Federal Tax Service at the place of registration, we hand over all the prepared documents to the inspector. At the same time, you can apply for your chosen tax payment system.
Now there is time to take a breath: your documents will be considered within 5 working days from the date of submission.

What you need to open an individual entrepreneur - we get the documents!

And now the waiting period has expired, you go to receive documents. What will you be given as confirmation of the status of an individual entrepreneur?

  1. Tax registration document
  2. Extract from the state register of individual entrepreneurs (EGRIP)
  3. Certificate of state registration as an individual entrepreneur (OGRNIP)

Also, you can immediately receive documents on registration in the Pension Fund, in the TFOMS and a notification on the assignment of codes in the statistical authorities. If they are not issued at the tax office, then you will need to go to all these authorities in order to collect a full package of all the listed documents.

When the documents are received, you can start carrying out entrepreneurial activity as an individual entrepreneur within the framework of the types that have been indicated.
However, there are cases when, based on the results of the consideration of documents, citizens are denied opening an IP. In particular, this happens due to incorrectly specified information or an incorrectly completed application. In any case, the refusal must be motivated.
If this happened, then the entire procedure for submitting documents will have to be repeated, while the state fee will need to be paid again, in the same amount.

We open an IP - the price of the issue!

The simplest, but also the most expensive way to register an individual entrepreneur is to delegate the solution of this issue to specialized firms. The employees of such a company will do all the work for you and provide you with a ready-made package of documents. The cost of such services in large cities usually starts at 5,000 rubles.

If you do everything yourself, then the minimum cost will cost 800 rubles to pay the fee, well, and the cost of photocopies of the necessary documents.
We complicate the options by resorting to the help of intermediaries. Notary services for certification of documents and signatures will cost an average of 400 rubles. It is difficult to translate the services of an intermediary into monetary terms, because if someone close to you is involved in solving this problem, it may not cost you anything, and if you hire someone from the outside, then the price, as they say, will be negotiable.

More options: you have decided that you, as an entrepreneur, need a checking account and a seal (which is not at all necessary for an individual entrepreneur). In this case, you need to add another 1000 rubles for opening an account and about 500 for making a seal.
If you have carefully read our article, then now you know what it takes to open an IE. By following our recommendations step by step, it will not be difficult to carry out the entire registration process without anyone's help. Good luck in your independent business!

An individual entrepreneur (individual entrepreneur) is an individual who has proper registration and conducts business activities without registering a legal entity.

Relying on Article 23, part one of the Civil Code Russian Federation, any capable citizen of Russia or another country has the right to conduct his own entrepreneurial activity in Russia.

Why open an IP at all?

Registration of an individual entrepreneur entails avoiding taxes on personal income (personal income tax), a decrease in payments to the Pension Fund (Pension Fund of the Russian Federation) and the FSS (Fund Social Insurance). On the other hand, the official registration of the IP opens before you more possibilities in cooperation with various firms and companies that prefer, interacting with your organization, to transfer money to current accounts by bank transfer, and then write them off to expenses.

At the very start of your career, it may be enough to work without official registration, when you are not yet working with large companies. But then you have to face the problems of limited opportunities and the reluctance of large organizations to work with your firm - no one has the desire to work with illegal clients.

It is for this that you need to open the IP and go on a "big voyage". As a result of official registration, you can go to new level, and you will have the opportunity to earn more.

What do you need to open an individual entrepreneur in 2019?

Before you start collecting paper for registration, it will be useful for you to familiarize yourself with the following points:

  • You must have a Taxpayer Identification Number (TIN). If on this moment you do not have it, there is an opportunity to issue an application to receive it. You can do this both together with the submission of the entire package of documents for registration of an individual entrepreneur, or in advance. Only in the first case, the registration will take much more time instead of the prescribed 5 working days.
  • You should decide in advance on the most suitable tax system for you.
  • You will need to decide on the types of activities that you will be engaged in ( OKVED codes). They must be indicated when registering an individual business. The code that you write first is considered first. It will determine the value of the insurance rate of the Social Insurance Fund (FSS).

Next, we will consider in more detail the second and third points from the above list.

Choice of taxation system and OKVED codes

Let's start with the systems by which the amount of the duty paid to the state is determined. All payments that are assigned to individual entrepreneurs are divided into 4 sections. It:

  • a fixed fee, which is paid to extra-budgetary funds "for oneself" (in 2019 it is 36,338 rubles, and if his income exceeds 300,000 rubles, then an additional 1% of the amount of income exceeding 300 thousand);
  • a fixed fee paid to extrabudgetary funds, which is charged from wages workers (the entrepreneur must exclude 13% of a person's income working for him);
  • additional taxes that are assigned in accordance with the type of activity;
  • taxes assigned depending on the taxation system you specified.

There are several payments of the latter type:

  • General taxation system.
  • Special modes, which in turn are divided into:
    • simplified taxation system (STS);
    • unified agricultural tax (UST);
    • unified tax on imputed income (UTII);
    • taxation system in the implementation of production sharing agreements.

Each of them has its own characteristics and criteria by which the amount of the payment is determined.

As for the OKVED codes, first you need to figure out what they are.

OKVED codes or All-Russian classifier types of economic activities are codes with encrypted and classified all types of activities that can be used if you have your own business.

When registering an individual entrepreneur, it is better to immediately decide what exactly you want to do and indicate not one, but several codes. Although, on the other hand, too many of them can lead to certain problems and confusion in numbers. From the choice of the main activity, i.e. the first code specified during registration depends on the size of the mandatory insurance rate.

It should be borne in mind that you can only engage in the type of activity indicated when registering, and each of the types of activity has its own taxation system. They may differ depending on the region in which you will be registering.

Required documents

If you nevertheless decide to register your own business, for this you will need a certain set of papers. It looks like this:

  • Passport.
  • A stitched photocopy of each page of the passport. You will need it to send a set of documentation by mail.
  • A receipt confirming the payment of the state fee for the registration of an individual entrepreneur.
  • A copy of the certificate with the taxpayer identification number (TIN), if available.
  • Application for registration of an individual as an individual entrepreneur in the form P21001. If the situation has developed so that the one who signed this paper for some reason is not able to bring the papers in person, it is necessary to certify them at a notary to certify the applicant's signature (1 copy).
  • Application for the application of the simplified taxation system (STS) in the form No. 26.2-1 (2 copies).

After submitting the documents, you must receive a receipt for their receipt and one of the copies of the transition to simplified system taxes. When submitting documents electronically from January 1, 2019, the state duty is not paid.

We write and submit an application to the tax

In order to be able to carry out non-cash payments, you will need open a current account... It will also be needed in case of concluding contracts for an amount exceeding 100,000 rubles with other individual entrepreneurs.

To draw up a current account and certify your documents, you will need own seal... Thus, if you have made a seal for yourself, then during the further work, one signature in order to certify the document will no longer be enough.

In the event that your activity involves payment for services using cash or bank cards, you will need a cash register. Although there are exceptions related to the chosen taxation system and some terms of trade.

Why can registration be refused?

The reasons why they may refuse to register you may be different. Below are the main circumstances under which this can happen:

  • If you entered incorrect data, made mistakes or typos when filling out the documents.
  • If you have submitted incorrect documents, or if they were not in full force.
  • When you submitted your documents to the wrong place.
  • If you are declared bankrupt and less than a year has passed since then.
  • If a sentence was imposed on the prohibition of entrepreneurial activity, and the term of its validity has not yet had time to come out.

As you can see, it is not difficult to formalize yourself as an individual entrepreneur. The main thing is to follow the instructions presented above, and you will succeed.

If we compare the registration of an individual entrepreneur independently and through an intermediary, then each of the options has its own advantages and disadvantages. Self registration it takes a little longer to collect the proper paperwork and get it done, although your costs will be negligible. Registration of an individual entrepreneur with the help of an intermediary, on the contrary, takes less time, but you will need to pay him for the work. Thus, the amount you spend will grow significantly. So the choice is yours.

Changes for 2019

Registration as an individual entrepreneur does not imply major changes. The main ones will be associated with tougher liability for committing certain violations:

  • In particular, if the registration authority doubts the reliability of the data provided by the entrepreneur, it will be able to stop the registration process for a period no more than 30 days.
  • Persons who have violated the law in the course of their previously organized entrepreneurial activities may be denied registration.
  • Administrative penalties will become stricter: for example, when incorrect information is provided for the first time, the fine ranges from 5,000 to 10,000 rubles.
  • Administrative responsibility is also tightened upon registration with the use of dummies. Moreover, now it is enough to have a statement on the part of the dummy director in order to prove the unlawfulness of the actions performed.
