Legal and regulatory framework governing the supervision of the production of works

Legislatively, the requirement for the implementation of the supervisory function is enshrined in the documents regulating the production of certain works. The right to carry out work of increased danger is obtained by persons who have received the appropriate work permit. In turn, a work permit for high-risk work is issued by a person who supervises the safety of work - a responsible manufacturer of work (supervising) or a responsible work manager, a member of the team. The order on the issuance of permit work orders, which assigns the supervisory function to specific specialists of the enterprise, is updated at least once a year.

The system for issuing work permits is described in the relevant regulatory documents, including local regulations approved by the management of the enterprise. Single state standard approved at the state level is absent today, therefore, be guided when developing internal system issuance follows a number of applicable sectoral (cross-sectoral) regulations and rules, in particular:

Who can be appointed responsible for the issuance of permit orders

At any enterprise, the production process of which is associated with conditions of increased danger, the management is obliged to approve the circle of persons responsible for the production, organization and admission to work. In accordance with the regulations of the above regulatory documents the person who issues the work permit must have the appropriate competence and special knowledge to organize the work.

The list of officials who have the right to issue work permits is approved in order the management of the enterprise. At the same time, the practice is widespread when the management of an enterprise appoints a special employee - a coordinator for work orders, fixing and controlling the processes of issuing, returning, combining and other related issues.

The basis for the appointment of a person responsible for the issuance of work permits becomes the corresponding order of the enterprise management, and the basis for the issuance of the order, in turn, becomes a local normative act on the organization of work of increased danger (instructions, regulations, etc.). A local normative act on the organization and conduct of work of increased danger is drawn up taking into account the industry (intersectoral) rules on health and safety and the specifics production processes enterprises.

The persons who may be responsible for the safe performance of work according to the permit include:

  • persons issuing an admission order;
  • responsible managers of work on work orders;
  • responsible executors of work on work orders;
  • members of the brigade performing work according to work orders.

It should be noted that the following combination of responsibilities of responsible persons is allowed:

  • the person who issues the work permit can simultaneously perform the function of a responsible work manager with the right to issue permit work orders.
  • the responsible work manager can simultaneously perform the function of the responsible work performer without the right to issue work permits.

Important: a person who has the right to issue work permits cannot simultaneously perform the function of a responsible executor of work. Each department head is obliged to have lists of responsible managers and performers of work, which are carried out according to work orders.

What are the requirements for the content when drawing up an order for the issuance of work permits

The preamble of the order for the issuance of work permits, as a rule, indicates a regulatory document approving the need to issue this order, for example:

Persons admitted to the issuance of work permits must be familiarized with the relevant order against signature.

In fact, the system for issuing work permits is somewhat more complicated than the one described. The system is described in the relevant regulatory documents, incl. local character. Unfortunately, there is no single document at the federal level; there are only some sectoral provisions and rules.

Rostekhnadzor Order No. 102 of March 14, 2014 approved the Federal norms and rules in the field of industrial safety "Requirements for welding at hazardous production facilities."

For work at height, as a normative document, one should use, among other things, the newly introduced "Rules for labor protection when working at height" (approved by order of the Ministry of Labor and Social Protection of the Russian Federation No. 155n of March 28, 2014).

Based on the requirements of the listed documents, an occupational safety engineer cannot be a person issuing a work permit. Firstly, he is already an approving person (in a number of sample orders there is a mandatory column "coordination with the OT service") and, accordingly, cannot coordinate work for himself (the principle of supervision is violated). Secondly, the person issuing the work permit must have certain competencies for organizing work, specific knowledge that an occupational safety engineer may not have.

There is a function for fixing the issuance of a work permit in the journal (by general rule) of the person issuing the outfit. However, there is a practice when a separate employee is allocated at the enterprise - a coordinator for work orders, who fixes the issue, return, cross work, etc. It can also be an employee of the OT service.

The order on the appointment of those responsible for the issuance of work permits must be based on a local document on the organization of work of increased danger. It is with such a document, and not with an order, that the organization of work of increased danger begins, since the order itself is only a small fraction of the work permit system.

Summarizing the above, the legality of the issuance of work permits by an OT engineer is considered to be contrary to the existing one. regulatory documents... Although, unfortunately, this practice exists.

Businesses often have to perform hazardous work or work in hazardous conditions. And when sending employees on such tasks, it is necessary to issue a special written order - a work permit to perform work. The form of such a document, as well as general order we will consider filling it out in the article.

When do you need admission?

Each company, depending on the specifics of the activity, will have its own list of situations when prior written permission is required. At the same time, the normative acts contain a list of activities when it is required. We are talking about all types of activities that require additional security measures, namely:

  • activities related to chemical, biological and other types of hazardous substances;
  • loading and unloading, high-altitude, diving, earthen, construction and assembly, fire, fire hazard, Men at work;
  • operation of thermal, refrigeration, gas, electrical installations.

What a sample work order looks like

Since each area of ​​production has its own characteristics, officials approved samples for each situation. Design features

The admission order is always drawn up in 2 copies: one for the organization, the second for the performers. It is issued only by persons with the appropriate level of training. In addition, they must be authorized by the management of the organization to write out such documents.

The director and / or technical director of the company, the chief engineer, the head of the department / department may issue orders for the execution of tasks. This person completes the first part of the document. After that, the paper is transferred to the head of the planned activity. He fills out his sections, for example, on job preparation and briefing. The next stage - the task is transferred to the person responsible for the task execution. This is the last person who fills out the papers, and at the end - hands them over for storage.

Note that the specialist who writes out the admission order can simultaneously be the one who further supervises and is responsible for the execution of the task. In this case, he draws up everything from start to finish on his own.

What should I write? The authorization form itself gives hints. The main thing is not to shorten the words, no matter how long they are. It is allowed to use only generally accepted abbreviations, to which inspectors will not "cling" during inspections. Be sure to indicate:

  • where tasks are performed;
  • what they are and what materials, tools and devices will be needed;
  • presence of harmful or dangerous factors at workplaces;
  • who is involved; if a brigade, then by name;
  • information about the briefing;
  • information about the security measures taken, including the systems used;
  • planned execution time (start and end of the shift in hours);
  • date and time of task execution.

V different areas production terms of validity of orders are different. For example, when performing hot work, the permit is valid only for one shift. If we are talking about activities at height, then the maximum document validity period is 15 days. If it was not possible to finish everything within the scheduled time, it will be possible to continue only after the extension of the previous one or the release of a new permit.

Information about all permits issued, without exception, must be entered into the register of work on orders and orders (the form and the completed sample can be downloaded at the end of the article). Sometimes such logbooks have different names, but the essence is the same - with their help the organization maintains control. The company is also obliged to keep “closed” orders for at least 30 days. If an accident occurs at the production site, the permit is attached to the investigation materials and then remains in the archive for 45 years.

Responsibility for failure to issue admission

Failure to issue orders can be qualified as a refusal to comply with labor protection requirements. For such an offense, liability is provided for under Part 1. In this case, officials and individual entrepreneurs face a fine of up to 5 thousand rubles, organizations - up to 80 thousand rubles. In case of repeated violation, officials can be disqualified for up to 3 years or fined 30-40 thousand rubles. The same punishment awaits the SP. Companies at best will have to pay from 100 to 200 thousand rubles, at worst - their activities will be suspended for up to 3 months.

Certain hazardous work, features and conditions, which require the use of special measures, prevent the possibility of exposure to hazardous and harmful production factors, are performed according to written permit-orders.

A work permit is a written order for the performance of work, which determines the content and scope of work, the start and end time of work, the safety conditions for its performance, the composition of the team, persons responsible for the safety of work, it is drawn up on a form.

The list of works with increased danger is issued for the coming year, signed by the chief engineer, to each head of the structural unit.

A work permit may not be issued if a written order has been given to carry out the work, a technical task has been issued, a technological process has been developed or another document has been drawn up, which defines the place and time of the work, a work manager and persons responsible for safety have been appointed.

By order of the head of the enterprise, persons responsible for the production of work with increased danger are appointed (the person issuing the outfit, managers and performers of work with increased danger).

The person issuing the work permit is responsible for the need to perform work, the correctness and completeness of the safety measures specified in the order, the sufficient qualifications of persons appointed by the managers and performers of the work.

The manager is responsible for the implementation of safety measures, the correctness of admission to work, acceptance of the workplace after its completion and supervises during work.

He is obliged to instruct the team, constantly be at the workplace and check the implementation of safety measures.

Work order forms are filled in in two copies: 1st copy. issued to the work supervisor, 2nd copy. remains with the outstanding outfit.

The validity of the admission order should not exceed five days.

At the workplace, the work permit is held by the work supervisor. At the end of the work, the outfit is handed over to the work supervisor. After the signature of the outfit by the manufacturer and the work manager, the admission order is handed over to the person who issued the outfit. The outfit is stored for 1 year.

When performing work on a permit, it is prohibited to:

Start work before receiving the order;

Change the scope of work;

To involve in the performance of work persons who are not specified in the work permit; perform at the same time other work not specified in the order.

The outfit is valid for the duration of the work.

Instruction on the procedure for issuing and filling out an order for the production of work with increased danger

1. Performance of work with increased danger is allowed only if there is a work order given to the workers.

2. The outfit is written out by the head of the production site (shop manager, department head, foreman) and handed over to the person responsible for the work, after the appropriate safety briefing. The outfit is issued against a receipt to the person in charge.

3. The work order must specifically list the methods of work, measures, devices and protective equipment that guarantee workers healthy and safe conditions labor.

Application

I. General

1. These Federal norms and rules in the field of industrial safety "Regulations on the use of work permits when performing work of increased danger at hazardous production facilities of the mining and metallurgical industry" are developed in accordance with the Federal Law of 21.07.97 N 116-FZ "On industrial safety hazardous production facilities "(Collected Legislation of the Russian Federation, 1997, No. 30, Art. 3588; 2000, No. 33, Art. 3348; 2003, No. 2, Art. 167; 2004, No. 35, Art. 3607; 2005, No. 19 , art. 1752; 2006, N 52 (part I), art. 5498; 2009, N 1, art. 17, 21; 2009, N 52, art. 6450; 2010, N 30, art. 4002; N 31 , Articles 4195, 4196) (hereinafter referred to as the Organization), apply to high-risk work performed at hazardous production facilities of the mining and metallurgical industry.

2. Work of increased danger includes:

repair, installation, commissioning and construction works carried out by the personnel of the shops, work on lifting, lowering and moving heavy and bulky items in the absence of cranes of appropriate lifting capacity, as well as during the transportation of oversized and unstable cargo;

repair work for large-sized equipment with a height of 2 m and more;

repair and construction, painting and installation work at a height of 2 m or more from the floor without inventory scaffolding and scaffolding;

maintenance of lamps from the gallery of bridge cranes and crane beams;

work on dismantling (collapse) of buildings and structures, as well as on strengthening and restoration of damaged parts and elements of buildings and structures; electric welding work outside and inside containers, work in closed tanks, cisterns, tunnels, pits and chimneys, where poisoning and suffocation of workers inside a hot furnace is possible; work on opening pressure vessels and pipelines;

work on testing pressure vessels;

work on the discharge of flammable liquids, acids and alkalis from tanks and other containers in the absence of special equipment for drain racks with mechanized drainage means;

repair work at ammonia stations, oxygen and ammonia pipelines;

works on cleaning and repairing air ducts, filters and fans of exhaust systems of galvanic workshops, chemical laboratories, warehouses and other premises in which strong chemicals and other substances are used and stored;

repair works of stationary and portable acetylene generators;

work on the repair, painting of industrial equipment, buildings, structures, cranes and cleaning roofs from snow in the absence of fences;

earthworks, as well as work in the area of ​​the location of energy networks, pipelines of compressed air, gas and liquid fuel;

digging pits and trenches more than 1.5 m deep and performing work in them.

3. The list of works of increased danger is approved by the technical manager of the organization in accordance with the production specifics.

4. Any repair, installation, commissioning, construction work in the shops and on the territory of the operating organization is considered to be high-risk work for contracting (service) organizations.

5. In organizations without a work permit, when performing work of increased danger, work can be performed on the daily maintenance of equipment by the personnel on duty and the repair services of the organization assigned to the main workshops.

6. Work of increased danger is carried out by at least two employees with the registration of a work permit for the performance of work of increased danger (hereinafter - work permit) according to the model in accordance with Appendix No. 1 to these Regulations.

7. Work on elimination of accidents can be carried out without issuing a work permit only until a direct threat to the life of people and equipment is eliminated. Further work on the elimination of accidents and their consequences should be carried out after the registration of the work permit.

8. Preparatory work to ensure the safety of high-risk work (clause 4 of Appendix No. 1 to this Regulation) is carried out by the customer's shop and the organization's repair services.

9. Closing the work permit after the end of the work is formalized with the signatures of the responsible manager and the work performer. The responsible manager makes a note in the spine about the time of receipt of the work permit from the contractor and ensures its storage. In the absence of a responsible manager, the work permit is closed and signed by the contractor and the shift (section) supervisor, the foreman. Closed permit work orders and their backs are returned to the person who issued them and are stored for one month.

Work permits for work, during the performance of which accidents and (or) accidents occurred, should be stored in the archive of the organization with materials on investigation of accidents and accidents.

10. Production sites, technological lines or stand-alone buildings, structures and equipment, as well as areas located outside the existing workshops, allocated for execution on them renovation works by the contractor (service) organization, must be taken out of operation and transferred to the latter according to the act-admission for the production of repair, construction and installation works on the territory of an operating enterprise (workshop, site) (hereinafter - the act), drawn up according to the sample in accordance with Appendix No. 2 to these Regulations.

In this case, the issuance of a work permit in accordance with the requirements of this Regulation is carried out by the contractor.

If existing conductors, gas pipelines, heat pipelines, melt pipelines, acid pipelines or other existing communications pass through the area allocated for the production of high-risk repair work, as well as technological load-lifting cranes, then the object cannot be transferred to the contractor according to the act.

II. Persons responsible for the safe performance of work and their responsibilities

11. By persons responsible for correct organization and the safe production of work of increased danger, are: issuing a permit-permit, admitting to work according to permit-orders, the manufacturer of the work, the performers of the work (members of the team).

12. The work permit is issued before the start of the work of increased danger. The list of positions entitled to issue work permits is approved by the technical director of the organization.

13. The person who issued the work permit appoints the admitting person (them) to work and is responsible for instructing and safety of the work, the correctness and completeness of the safety measures specified in the work permit and the compliance of the performers' qualifications with the assigned work.

14. The issuing work permit introduces the admitting person to work under work permit (hereinafter - admitting to work) with the safety measures provided for by the permit work permit, monitors their implementation.

15. When carrying out work in several shifts, for the entire period of validity of the permit-order, several persons admitting to work are assigned in accordance with the number of shifts.

16. Admitting to work can be:

specialists of customer shops;

specialists of contracting (service) organizations performing work at the facility adopted under the act.

17. The person admitting to work is responsible for the implementation of measures to ensure the requirements of the rules in the field of industrial safety specified in the work permit, including:

for disconnecting the facility from steam, water, gas, electrical power sources and installing grounding;

for installing plugs for all types of pipelines (communications), cleaning gas ducts and dust pipelines, blowing and steaming pipelines, cleaning equipment from dirt, dust, acid, blowing and ventilating gas ducts and equipment, for performing other preparatory work;

for the allocation of the repair, installation, construction zone from the existing equipment and communications with fences, dead ends, safety signs, signaling means and posters.

18. A person admitting to work before being admitted to work, as well as when extending a work permit, is obliged to check the implementation of measures to ensure the requirements of the rules in the field of industrial safety specified in the work permit, to instruct the work producers about the specifics of work in this operating workshop and directly on place of work.

19. When performing work of increased danger in the area of ​​operating units with liquid metal, the issuing work permit is obliged to appoint from among the specialists of the workshop technological personnel a person responsible for the timely withdrawal of the repair personnel to a safe place during transportation, pouring, purging, releasing liquid metal and subsequent admission of repair personnel to work. Position and surname responsible person are entered in the work permit (clause 4.10 of Appendix No. 1 to these Regulations).

20. When performing work at an object adopted under an act, the responsibility for the correctness and completeness of the implementation of measures to ensure labor safety specified in the work permit is borne by the employees of the contracting (service) organization who performed these measures.

21. In the event of a break in work during one shift (lunch break, break according to the conditions of work), the work permit remains with the work manager and the team after the break starts work with his permission. After finishing work workplace is put in order, the admission order is handed over to the responsible work manager (the person who issued the admission order). The interrupted work can be started only after receiving the work permit.

22. If the technological personnel, warned about the performance of work according to the permit, has ended the shift, and the repair personnel is still continuing, then the admitting to work must warn the technological personnel starting to work about the work on the permit and agree on the work order. admission with the head of the shift that started work.

23. Producers of works can be:

specialists of technological, mechanical, electrical and energy services of the organization;

specialists of contracting (service) organizations - specialists of organizations performing work at the facility, adopted under the act.

24. When performing work in several shifts, for the entire period of validity of the work permit, several work producers are assigned in accordance with the number of shifts.

25. Before starting work, the contractor is obliged to instruct the team (s) on safety measures at the workplace. The briefing is executed according to the model specified in the appendix to the permit.

When changing the composition of the brigade, the work supervisor is obliged to instruct the workers newly introduced to the brigade.

26. The manufacturer of the work is responsible for the completeness of the instruction on industrial safety, for the observance of safety measures, the correct use of overalls and means individual protection and serviceability technical means labor safety.

27. Performers (team members) are responsible for compliance with the industrial safety requirements provided for by the work permit, for the correct use of overalls and personal protective equipment, as well as for compliance with labor and production discipline.

In the event of a replacement of a work supervisor or an admitting to work, the names of the newly appointed work supervisor and admitting to work must be entered in the appropriate columns of the work permit.

III. Registration of work permit and work performance

28. The work permit is drawn up in the shop-customer, where it is supposed to carry out work of increased danger, or in the contractor (service) organization, if the work is carried out at the facility, adopted under the act.

The issuance of a permit-order is registered in a special register of permit-orders according to the model specified in Appendix No. 3 to this Regulation.

29. A work permit is issued for the period necessary to complete a given amount of work.

30. With the simultaneous work of several contracting (service) organizations at one facility, before issuing a work permit, the customer enterprise, together with the contracting (service) organizations, develops additional measures for industrial safety, includes them in the work permit (clause 4.10 of Appendix No. 1 to to this Regulation), which is issued to the manufacturer of the works of each organization.

31. Work carried out near existing railway lines, highways, power lines, hidden communications, as well as all earthworks must be preliminarily agreed by the customer shop with organizations or shops serving these facilities, and the relevant documents (communication schemes of power grids and disconnection of equipment from operating units with an indication of the installation location of connectors, plugs, fences) must be attached to the permit.

32. Prior to starting work, the work permit must be signed:

who issued the admission order;

persons performing industrial safety measures specified in the work permit;

by persons who have agreed on the admission order;

a responsible person appointed in accordance with clause 19 of these Regulations;

admitting to work;

manufacturer of works.

33. When the brigade is admitted to work, the admittancer gives the work permit to the manufacturer of the work, and keeps the spine for the admittance to himself.

34. When accepting a shift, the manufacturer of work is obliged to accept the work from the shift manager along with the work permit and personally check the production conditions, as well as make a note in the work permit on the extension of work and not start work on the work permit without the permission of the admitting person to work.

35. The admittancer must stop the work and withdraw the work permit, if, before the end of the work under this permit, a discrepancy is found between the actual state of the work conditions and the requirements of the industrial safety rules stipulated by the permit, or there is a need to connect to the equipment being repaired. (unit, system) of existing equipment or energy communications.

36. If it is necessary to temporarily stop the repair, as well as when scrolling and testing the equipment, according to the instructions of the admitting to work, the contractor removes the subordinate personnel from the repair facility and returns the work permit to the admitting to work.

The resumption of work is carried out with the permission of the admitting person to work after checking all the initial measures to ensure the safety of those working on the work permit, and the return of the work permit to the manufacturer of the work.

37. In case of a break in work for more than one shift, it is allowed to extend the work permit after checking the invariability of the measures to ensure the safety of work specified in the work permit by the admitting person and the manufacturer of the work.

If the work permit is lost, the work must be terminated. For the continuation of the work, a new work permit must be issued and the admission to work must be renewed.

38. The management of the customer's shop has no right to start operation of the equipment after repair until the return of the closed work permit by the manufacturer (s) of the work.
